Here are the most important things to know.

You Own Your Mind (and Your Content)

You retain full ownership of the intellectual property you create in your journal—your words, your photos, your ideas. We will never claim rights to your content. You simply grant us a license to store and display it for you while you use the service.

Be a Good Human

SocialGem is a sanctuary. When you use public-facing features like the Pulse or Fediverse integration, you agree not to harass, spam, impersonate others, or post content that is hateful, abusive, or illegal. We have a zero-tolerance policy for this.

Your Responsibilities

You are responsible for keeping your account password safe. You must be at least 13 years old to use SocialGem (or older, depending on your country's laws). You are also responsible for the inputs you provide to Quest AI and ensuring they are lawful.

Our Rights

We reserve the right to suspend or terminate accounts that violate these terms to protect the safety and integrity of our community. We may also change these terms from time to time, and we will notify you of any significant updates. Continuing to use the service means you accept the new terms.

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services (collectively, the "Services") provided by SocialGem LLC ("SocialGem," "we," "us," or "our"). Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

2. Your Account and Responsibilities

You must be at least 13 years old to use the Services. You are responsible for safeguarding your account information, including your password, and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. User Content

A. Your Rights

You retain ownership of and all intellectual property rights to the content you post, upload, or create in the Services ("User Content"). We do not claim any ownership rights to your User Content.

B. License You Grant to Us

By creating User Content, you grant SocialGem a worldwide, non-exclusive, royalty-free license to host, store, transfer, display, perform, reproduce, and modify your User Content for the sole purpose of operating, developing, providing, and using the Services. This license ends when you delete your User Content or your account.

4. Acceptable Use Policy

You agree not to use the Services to:

  • Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Violate the privacy or intellectual property rights of others.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation.
  • Engage in any activity that interferes with or disrupts the Services.

We reserve the right to remove any User Content and terminate accounts that violate this policy.

5. Quest AI

Our AI-powered features, including Quest AI, are part of the Services. Your use of these features is subject to these Terms. You are responsible for the inputs you provide to the AI and for your use of its outputs. You may not use Quest AI for any illegal or harmful purpose. Due to the nature of machine learning, AI outputs may not always be accurate and should be independently verified.

6. Paid Services and Subscriptions

Some of our Services may be subject to payments now or in the future ("Paid Services"). Please note that any payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of this Agreement. We use a third-party payment processor to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to this Agreement.

7. Termination

You are free to stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services with or without notice for any reason, including, but not limited to, a breach of these Terms.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. SOCIALGEM DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALGEM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES.

9. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

10. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a notice within the Services. Your continued use of the Services after any modification constitutes your acceptance of the new Terms.
